The present terms and conditions of sale are agreed between the Seller, BVBA Chocolaterie Hans De Groote on the one hand and on the other hand the User who reserves or orders products via the web shop www.best-chocolates.com. 3. ORDER
You can order from the age of 18 or older, provided that you are not incapacitated. If one does not fulfil these conditions, one must be represented by a parent or legal representative.
The online order can only be processed if the User has clearly identified himself during the step-by-step plan proposed in the ordering process. The User himself is solely responsible for the correctness of all entered data. With an initial order, the customer is given the option to continue as a guest, or to follow the registration procedure. In the latter case, a registration is sufficient to place a new order.
The Seller undertakes to process the order according to the possibilities that the stock has and according to the limitations stipulated in these conditions. In case of unexpected stock failure, the Seller must inform the User and provide the Seller with the right to cancel the reservation for an order. In this case, the Seller will provide an accurate refund.
When confirming the order, the User accepts the order at the set price, these General Terms and Conditions as well as all transactions via the website. Only then the order will be considered as definitive. After accepting payment, BVBA Chocolaterie Hans De Groote will always send a confirmation email of the order to the customer.
BVBA Chocolaterie Hans De Groote reserves the right to subject an order to additional conditions or even to refuse the order in the following cases:
- in case the order is flagged by the security systems as an unusual order or an order suspected of fraud;
- when there is reason to believe that the customer intends to order for unacceptable commercial purposes;
- when there is a stock issue or when a product is no longer available;
- in the event of force majeure.

Companies, works councils, communities, associations or clubs that are entitled to discounts through volume purchase can contact Customer Service directly for a price quote. All questions will be answered personally as soon as possible.
4. PAYMENT
BVBA Chocolaterie Hans De Groote provides the possibility to pay safely and smoothly using various payment methods. The accepted payment methods are listed on the website. The customer pays via the payment platform Mollie and receives a payment confirmation by e-mail.For payment methods with credit cards and security in this regard, we refer to our Privacy Policy.
The shipping costs are stated with the order before the customer confirms definitively. After payment confirmation, the customer's order is processed and shipped immediately.
5. DELIVERY
BVBA Chocolaterie Hans De Groote does everything possible to ensure a smooth shipment to the customer. Hereby the freshness of high-quality products comes first. Shipments are always carried out by a professional courier.
5.1 DELIVERY TIME
The transport time, expressed in working days, starts on the day the package is delivered to the courier service. The User will then receive a tracking code by e-mail in order to track the package.
The delivery term stated on the order confirmation is respected as far as possible. Should there be a delay in this delivery time, for whatever reason (force majeure, incorrect or incomplete address, ...), this can never give rise to any compensation.
If multiple items are ordered, delivery will only start when all items are available. In busy moments, delivery time may incur to several working days. For a large order more time may be needed as well. After all, everything is freshly packed, according to the customer's wishes.
Deliveries are only done on working days between 8am and 6pm, not on weekends and not on public holidays. At temperatures above 25 ° C, orders are not sent on Thursdays (except to Belgium, the Netherlands and Luxembourg ) nor on Fridays, because during the weekend there is no control over the temperature in the storage areas of the courier companies.
If the requested delivery date is not achievable, the User will be informed by email. If the User's order is not delivered on time, the User can contact the Customer Service (Article 1), stating the order number. Should BVBA Chocolaterie Hans De Groote, due to exceptional circumstances, fail to send the order within 30 days of the order confirmation email, this order can be cancelled free of charge and the refund will be guaranteed.
For shipments outside the European Union, it may exceptionally occur that customs carry out a physical inspection of the package. This intervention can lead to a delay of the delivery time from 24 to 96 hours. BVBA Chocolaterie Hans De Groote cannot be held responsible for this incident.
5.2 DELIVERY ADDRESS
Deliveries are only made in the countries mentioned on the website. For the following countries, deliveries are only on the mainland and not on the islands: France, Greece, Italy, Portugal and Spain. Deliveries are not made to PO Box addresses.
If the purchaser has provided an incorrect or incomplete delivery address, it is his responsibility and this may lead to additional costs that will be covered by the purchaser. The purchaser then also loses the right to refund and costs for a new shipment are borne by the purchaser.
In the absence of the consignee, the shipment will be taken to a collection point. If it is not picked up there within 7 days, the package will be returned to BVBA Chocolaterie Hans De Groote. In the abovementioned case, the shipment will not be eligible for refund if it contains products with a limited shelf life (shelf life less than 3 months after shipment). Costs for a new shipment are borne by the purchaser.
5.3 PACKAGING
BVBA Chocolaterie Hans De Groote uses packaging materials to protect the products optimally. Potentially harmful ambient temperatures are also taken into account. Partly thanks to these precautions, BVBA Chocolaterie Hans De Groote cannot be held liable for damage caused by transport and related costs.
5.4 DELIVERY EXEMPT FROM VAT (IC DELIVERY)
According to art. 39 of the Code, foreign customers with VAT number can receive deliveries that are exempt from VAT. This is subject to an order of at least € 135. In that case, the order will not be placed via the web shop, but the order must be placed at least 1 week before delivery via email: info@best-chocolates.com.
6. CANCELLATION OF AN ORDER
6.1 DEFECTIVE PRODUCT/ WRONG DELIVERY
When the order is received, the User shall be considered to inspect the goods immediately. If it is found that the delivery is not in accordance with the request, the User does not sign the delivery note and / or clearly states the problem on the courier's receipt. Within 24 hours, the User will inform BVBA Chocolaterie Hans De Groote about the problem via the following email address: info@best-chocolates.com.
6.2 RIGHT OF WITHDRAWAL
The purchaser has the right to withdraw from the contract within 14 days without a statement of reason. The withdrawal period expires 14 days after the day on which the purchaser or a third person designated by the purchaser, who is not the carrier, physically takes possession of the shipment.
To meet the withdrawal deadline, it is sufficient for the purchaser to send its communication concerning its exercise of the right of withdrawal to BVBA Chocolaterie Hans De Groote before the withdrawal period has expired.
If the purchaser withdraws from the contract, he must return the goods to BVBA Chocolaterie Hans De Groote at his own risk and costs. This needs to happen as soon as possible and no later than 14 days after the day on which the purchaser has notified the decision to withdraw from the contract.
The purchaser is liable for any diminished value of the goods resulting from the handling of these goods other than what is necessary to establish the quality of the goods.
This right of withdrawal does not apply in following cases:
- the supply of goods specially designed for the User;
- the supply of goods which are liable to deteriorate or have a limited shelf life;
- the supply of goods which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery.
6.3 RETURN SHIPMENT
Only goods purchased online are eligible for return.The procedure to follow for a return shipment:
- Step 1: Contact info@best-chocolates.com and state your order number, as well as an unambiguous statement and a photograph of the product to be contested. Or send a completed Withdrawal Form back to BVBA Chocolaterie Hans De Groote by e-mail or by post. Return instructions are then emailed. The return costs mentioned in the mail are to be borne by the purchaser.
- Step 2: Goods are to be packed before they are returned (only unused goods, in original packaging and complete with original labels and accessories)
- Step 3: The return label is printed and pasted on the box(es). The purchaser ensures the consignment is adequately franked. If the consignment exceeds 50 EUR, the shipment must be made by registered mail. A courier service is advised, as is shipping insurance. A copy of the invoice is attached and a copy of the statement or withdrawal form.
- Step 4: If the goods reach BVBA Chocolaterie Hans De Groote in good condition, the purchaser will be refunded as soon as possible. Should the goods be incomplete or damaged, the purchaser will be informed.
BVBA Chocolaterie Hans De Groote reserves the right to refuse or not refund returned items if the packaging has been opened or if the products have been used or damaged by the purchaser. Unstamped or insufficiently stamped shipments are always refused and returned to sender.
The full liability of BVBA Chocolaterie Hans De Groote will never exceed the purchase price of the product in question.
